The rules governing the use of BharatKaar.

§ 1 General provisions

BharatKaar operates internet-accessible databases (website and mobile apps) where vehicles can be offered for sale and searched in India. The public section is open to both private and commercial participants. Use by minors is prohibited. BharatKaar only provides the technical conditions required to relay listings, has no influence over their content, is not the seller of the listed vehicles and does not act as a party or intermediary in the relationship between seller and buyer.

§ 2 Service description

BharatKaar’s service consists of providing an input interface for listings and making them accessible via the internet and the app. To increase reach, BharatKaar may publish and promote the service and listings through third parties (e.g. social networks). EMI figures shown on listings are indicative only and are not a loan offer.

§ 3 Registration and user account

Use requires registration. Information must be complete and accurate. Users must correctly state their status (private/dealer). Passwords must be kept confidential. Accounts may not be transferred.

§ 4 Listing requirements

Participants may only post listings in the designated categories and only for vehicles they are entitled to sell. Listings must contain accurate information (year of registration, kilometres driven, number of owners, fuel incl. CNG kit, accident damage, loan/hypothecation status). Prices must be stated as the final asking price in Indian Rupees (₹).

§ 5 Liability

The participant alone is responsible for the content of their listings and for completing the sale lawfully, including RC transfer at the RTO. BharatKaar assumes no liability for accuracy or completeness. BharatKaar is liable only for intent and gross negligence. In the event of a breach of essential contractual obligations, BharatKaar is also liable for slight negligence, with liability limited to foreseeable damage.

§ 6 Prohibited practices

The use of data mining, robots or scraping technologies to read the database is strictly prohibited. Manipulating search results through keyword spam, posting fake listings or asking for advance/token payments for vehicles the buyer has not seen is prohibited.
